EXTRACT NSW CODE OF CONDUCT FOR SHORT TERM RENTAL ACCOMMODATION

2.5 Guests obligations

Guests to act lawfully
2.5.1 A guest must not engage in conduct in their capacity as a guest that contravenes:
a) the criminal law
b) planning laws or by-laws (if the premises are in a strata or community scheme) that apply to the premises
c) the terms of a short-term rental accommodation arrangement for the premises.

Obligations to neighbours
2.5.2 A guest must not at any time during the occupancy period:
a) create noise that because of its level, nature, character, or quality, or the time it is made, is likely to harm, offend, or unreasonably disrupt or interfere with the peace and comfort of neighbours and other occupants of the premises
b) act in a violent or threatening manner towards neighbours or other occupants of the premises
c) act in a manner that could reasonably be expected to cause alarm or distress to neighbours and other occupants of the premises
d) use or enjoy the premises in a manner, or for a purpose, that interferes unreasonably with the use or enjoyment of common property by neighbours and other occupants of the premises in a strata or community scheme
e) intentionally, recklessly or negligently cause damage to premises, any common property or any other communal facilities within the immediate vicinity of the premises, or any public property in the vicinity of the premises
f) intentionally, recklessly or negligently damage the personal property of neighbours of the premises or other occupants of a strata or community scheme.
This section is an offence provision under section 54C of the Act.
2.5.3 The Commissioner may issue guidelines about what may or may not be appropriate conduct under section 2.5.2 of the code.

2.5.4 A guest must not copy, or knowingly retain after the end of the occupancy period, any keys, security passes or other instrument that facilitates access to the premises. This is an offence provision under section 54C of the Act.

Responsibilities to Hosts
2.5.5 A guest must take reasonable care of the host’s premises and the hosts’s property at the premises.
2.5.6 A guest must notify the host or the host's representative of any dispute or complaint about a guest or visitor’s behaviour as soon as possible after the dispute or complaint arises.
This section is an offence provision under section 54C of the Act.

Exclusion register
2.5.7 A guest who is recorded on the exclusion register is prohibited from entering into any short-term rental accommodation arrangements as a guest.

Guests responsible for conduct of visitors
2.5.8 A guest is responsible for the actions of visitors they invite onto the premises during the occupancy period and must ensure visitors to the premises comply with section 2.5.2 of this code as if they were a guest on the premises.

- "We had a really good long weekend at this property. The house is beautifully decorated and spacious. We didn't use the outdoor BBQ as it looked like it was in need of a good clean. The back yard was very overgrown with long grass and weeds in the gardens. Not the sort of yard kids could play in. The outdoor area and furniture really needed a good clean. One day was extremely hot there and the air-conditioner wouldn't work! It was extremely uncomfortable. We couldn't find a manual for it. Tried calling the agent but couldn't get through. We sent a text but got no reply. The bathroom is nicely renovated but the water pressure is really low! The main bed has a very soft mattress and the road noise can be heard if you have a window open. The location is great with the beach access just a street behind the house."

There is so much to discover and explore with endless lakeside and coastal bike and footpaths, easy access to Budgewoi beach and a short drive to Norah head and Soldiers beach. The space
On the ground floor, we have pool and ping pong tables, bathroom, kitchen and smart laundry. On the next level, is the perfect open plan living area, leading out to the expansive deck. A few more steps and you have two bedrooms (one with en-suite) and the main bathroom. The top level has the master king sized bedroom with toilet and a second bedroom which has a queen sized bed. We also have a dedicated work space, with gorgeous views overlooking the lake (warning- you make be distracted from your work!).

Guests have access to the whole house except for a few cupboards that are used for storage.

This is a quiet residential area, so relax and enjoy everything Mother Nature has to offer. The neighbourhood has a chilled vibe, with cafe's, activities and entertainment all at your doorstep. - "Clean , homey so very comfortable. Our beds were so comfortable , linen very luxurious we felt like we where floating. We all want to stay here again.thank you" - "The place looked nice enough on entering but we discovered the following: 1. There was no air conditioning except one bedroom on the top floor and the air con in the living area didn’t work. We discovered later that the filter had not been serviced and was full of dust. The owner refused to get a technician even after Christmas. We had to do a 1 hour round trip on Christmas Day to collect 2 small (and totally ineffective) fans from her place. Then on Boxing Day she dropped off 3 new cheap and noisy fans after we complained to Stayz/VRBO which we had to assemble ourselves. Shocking! 2. There were bed bugs in one of the bedrooms which we discovered on the first night and luckily we took pictures because the owner tried to accuse us of introducing the bugs in the house!We had to sleep on air beds (which we luckily had as we had bought as Christmas presents) the whole week as one bedroom was unusable. The house was so hot. There were no fans in the lower floor and the play area could hardly be used as it was so hot and stuffy. The holiday was a nightmare and very, very disturbing for us especially for my aged and frail parents whom we couldn’t move to another place. Please note, just to enter the house to the living areas,there are 16 stairs and another 3 just for the bathroom so be mindful if there are issues with elderly people climbing stairs.The place is completely unsuitable for summer living in my opinion."

Cleaning is to be desired. Othe kitchen is not fully equipped such as only 1 wine glass. Should you wish to stay indoors, home entertainment stretches far in our humble abode, with three TV's and access to your Netflix, Prime, Stan & other streaming accounts.

Dining options are plentiful or stay home and cook up favourite delicacies on the new BBQ or indoors on the host of high end kitchen appliances; and enjoy all your family meals on the outdoor seating watching the world go by.

After lunch, why not take a splash? Provided is one adult kayak and one child kayak, both with life jackets for you to use. Please always be safe around bodies of water and ensure children and all swimmers are supervised while in or around the water.

*Check-in: After 3:00 pm
*Checkout: 10:00 am

*No parties or events

ADDITIONAL RULES:

*This is a no-party property. We do not allow parties/events of any sort. The maximum amount of guests allowed to sleep in this property is ELEVEN people, however, we do allow day visitors of up to FIVE people. No more than a maximum of SIXTEEN people are allowed in the property at any given time.

*In compliance with applicable legislation, we are required to enter a Short Term Rental Agreement with Guests upon booking. We are also transitioning from collecting a Security Deposit and will now be using a Pre-Authority form to hold as a form of security for your stay.

*Only the guests staying at the property are permitted to be present. If you wish to have visitors in addition to booked guests, you must advise us in writing prior to your stay and ensure you receive written permission.

*This home is a strictly no-smoking property. If any of our cleaners find any form of cigarette ash, butts or smell cigarettes in the home, we could issue a $500 fine.

*This is a domestic residence and we love our neighbours. We do not allow loitering or loud noise outside of the premises or inside of the premises. We ask for minimal noise especially after 9 pm.

*STRA Rules - By booking this home you automatically agree to all the STRA terms and conditions that are applicable to guests. You also agree that if you do break any of the house rules you will be asked to leave and no refund of the unused nightly rates will be returned.

*Check-in/Check-out - We cannot stress enough the importance of checking out on time. Our regular check-in time is after 3 pm and check-out time is before to 10 am. If you wish to have an earlier check-in or later check-out, please reach out to us first. Please note, there may be a charge.

*Changing of Dates Terms & Conditions
- Requests to change booking dates may only be accommodated if check-in is more than 1 month away.
- This is subject to approval and we reserve the right to decline any requests.
- Please note that there may be a surcharge to change the dates.
- Any changes to bookings are subject to approval and we ask all guests to reach out to us first.

THINGS TO KNOW:

* Check-in details will be sent either the night before checking in or the morning of check-in for security reasons.

* We only provide 1 set of keys for each stay. We do not have extra sets.

*The fireplace & firewood are for display only and not to be used.

*The home has a ducted cooling/heating system upstairs only. There are portable fans for the downstairs rooms.
