A Stay Above The Rest, LLC
SHORT TERM RENTAL AGREEMENT

This Short Term Rental Agreement (the “Agreement”) is made by and between A Stay Above the Rest LLC (“ASATR”) and _____________________ (“Guest”)* as of the date last set forth on the signature page of this Agreement. For good and valuable consideration, the sufficiency of which is acknowledged, the parties hereby agree as follows:

Guest. The term “Guest” shall include Guests, Invitees, their successors, heirs, agents and assigns including any minors.

Property. The property (“Property”) is located at:

The property is furnished and includes such items as: fridge/freezer, stove/oven/microwave, cooking utensils and equipment, bed sheets, bath towels, beach towels where necessary, essential cooking spices, baking and cooking supplies. [this is not a comprehensive list.]

Rental Party: The rental party shall consist of Guest and not exceed the maximum number of occupancy allowed.

Maximum Occupancy: Maximum number of guests is listed on each property listing site.

Minors and Legally Incapacitated Guests: Minors are defined as anyone under the age of 18. Anyone under the age of 18 or legally incapacitated must have a guardian sign and take full responsibility for any and all damages and/or penalties. In the sole discretion of ASATR, the guardian also be required to make an additional security deposit.

Term of the Lease. The lease begins at 4:00 p.m. on ___________, 20__ (the “Check-in Date”) and ends at 11:00 a.m. on _________, 20__ (the “Checkout Date”). If the Property appears dirty or damaged upon Check-in, Guest shall inform Manager immediately.

Minimum Stay: Minimum stay is listed on each booking site according to the appropriate season, date, weekend, etc.

Rental Rules: Guest agrees to abide by the Rental Rules attached as Exhibit A at all times while at the Property and shall cause all members of the rental party and anyone else Guest permits on the Property to abide by the following rules at all times while at the Property. Guest is responsible for any damage or costs caused by the negligence or intentional acts of all persons who Guest permits to be on the Property. If Guest does not abide by any of the rental rules, the Guest stay may be terminated with no refund as well as any fines and or fees associated.

Access: Guest shall allow Manager access to the Property for purposes of repair and inspection. Manager shall exercise this right of access in a reasonable manner.

Rental Rate and Fees; Damages
Deposit: No security deposit is required unless otherwise stated by booking agent/site. However, payment for the rental stay must be paid in advance
Fireplace (if applicable): Failure to properly clean ashes from the fireplace, if used, will result in a $50 charge
Fire-pit (if applicable): Failure to properly clean ashes from the fire-pit, if used, will result in a $50 charge
BBQ Grill (if applicable): Failure to properly clean the BBQ grill, if used, will result in a $50 charge
Charge for Damages: Manager shall communicate all claims of damage to Guest within 14 days after the Checkout Date for the following:
Damage to the property
dirt or other mess requiring excessive cleaning;
failure to adhere to the rental rules outlined in exhibit A; or
any other cost incurred by Manager or the Owner due to Guest’s stay.

Rental Rate. Rental rates will be communicated via booking site. Payment in full shall be due according to time frame specified by booking site.

*Cancellation Policy: If Guest wishes to cancel his/her reservation, the prepaid rental will be refunded as follows:

100% (minus cancellation fee) if canceled more than thirty (30) days prior to Check-in Date
0% if canceled fewer than 30 days prior to the Check-in Date
If rates fluctuate, both owner and guest will abide by rates agreed upon in this contract.
Cancellation Fee: $150 for standard reservations ; $200 for standard reservations that are defined as peak season.
Peak season dates include, but not limited to, the following large events such as, but not limited to, SXSW, ACL, Lone Star Rally, Formula One; Holidays such as Memorial Day, Easter, Fourth of July, Labor Day, Thanksgiving, Christmas, New Year’s Eve; or Seasonal such as Spring Break, Summer Dates (Memorial Day – Labor Day)
If Guest cancels on or after 30 days prior to Check-in Date, no rental fees (including the administrative fee) will be refunded

*When booked through Marriott HVMB, these cancellation policies do not apply. Please refer to Marriott HVMB for the cancellation policy that applies.

RELEASE, DEFEND, INDEMNIFY AND HOLD HARMLESS:

ALL GUESTS AS DEFINED IN PARAGRAPH 1 ABOVE AGREE TO RELEASE, DEFEND, INDEMNIFY AND HOLD THE RELEASED PARTIES, BOTH OWNERS AND PROPERTY MANAGERS OR AGENTS, HOLDIGN THEM HARMLESS FROM LIABILITY OR CLAIMS, DEMANDS, DAMAGES AND COSTS FOR OR ARISING OUT OF:

ANY DAMAGE, INJURY, DISEASE, SICKNESS OR DEATH TO GUESTS OR INVITEES, RELATED TO THE USE OR OCCUPATION OF THE DWELLING PLACES, GROUNDS, SWIMMING POOL OR OTHER FACILITIES; OR
ANY DAMAGE OR LOSS TO PERSONAL PROPERTY CAUSED BY OR RELATED TO THE USE OR OCCUPATION OF THE DWELLING PLACES, GROUNDS, SWIMMING POOL OR OTHER FACILITIES.

ALL GUESTS AS DEFINED IN PARAGRAPH 1 ABOVE UNDERSTAND, ACKNOWLEDGE AND STIPULATE THAT THIS AGREEMENT INCLUDES ANY SUCH CLAIMS, DEMANDS, DAMAGES AND COSTS ARISING OUT OF NEGLIGENCE ON THE PART OF THE RELEASED PARTIES.

11: NO REFUNDS FOR INABILITY TO ACCESS OR USE RENTAL PROPERTY

IN THE EVENT EVENTS BEYOND THE CONTROL OF THE LANDLORD INCLUDING BUT NOT LIMITED WEATHER SUCH AS HURRICANE, BLIZZARD, SNOWFALL OR FREEZING RAINS, EXCESSIVE RAINFALL, FLOODING OR DAMAGE OCCASIONED THEREBY MAKING EITHER ACCESS TO OR OCCUPATION BY GUEST IMPOSSIBLE OR UNDESIRABLE, NO REFUNDS WILL BE MADE. Responsibility for Accommodation:

- As a Guest, you acknowledge and agree that you are responsible for maintaining the Accommodation in the condition it was in upon your arrival. You are liable for your own actions and those of any individuals you invite to or grant access to the Accommodation.

It is nestled under majestic live oaks with the prevailing wind blowing through their canopies; you'll notice no background freeway noise, only peace, quiet and privacy; deer/ bird watching; sterling sunsets, boat traffic along Lake Travis. **
Inside, there's rustic cedar furniture, vaulted cedar beam ceiling, full kitchen and dining; Bath includes a shower made with fossils found on property, or relax in a refreshing private outdoor shower; museum quality arrowheads are also to be found on property (you find, you keep). kayaks or canoe provided. Boat rentals nearby. Nice playscape for children in adjacent park.

The condo features a spacious wrap-around balcony that includes an outdoor entertainment bar, a cooler, a wine barrel bistro table, and an electric grill. It offers comfortable seating and an outdoor TV for watching your favorite shows, movies, and sports, all while enjoying breathtaking views of the surrounding hill country.
The interior is tastefully appointed, and the kitchen is fully outfitted to meet all culinary needs. Comes complete with oven, full size stainless steel refrigerator with water filter, microwave, also provided is coffee and tea.

The master suite includes a highly-rated Tuft and Needle king-size bed and an en-suite master bath, with linens provided for guest convenience. In addition, the condo features a half bath and a living area that includes a pull-out queen sleeper sofa with extra comfort padding, complemented by a cozy fireplace. A washer and dryer are also available for guest use within the unit.

Nearby attractions include a day trip to Austin which is less than 45 minutes away, providing access to a wide range of major attractions. Also there are great day trips to Marble Falls and Fredericksburg which is the Texas wine capital area!

Prior to arrival, guests will receive check-in information that includes the front gate code, parking space assignment, directions to the condo, and a door code for their convenience. Covered parking is available for one vehicle, while additional guest spaces are designated for day-use guests only. Please be advised that Lake Travis is not a constant-level lake; its water levels fluctuate with seasonal changes and rainfall.
*******The high water boat ramp is now open once again! Please use caution when using this ramp and remember that the cove area all the way past the marina is a no wake zone!

This resort features a combination of full-time residents and short-term vacation tenants. Guests are kindly requested to maintain a respectful atmosphere, particularly after 10 PM, by refraining from loud music and disturbances in both the pool area and on the condo balcony.

Villa Rental Regulations:
The following regulations must be adhered to by all renters. Violations of these rules will result in the assessment of fines.
1. **Occupancy Limit:** The condo accommodates a maximum of four guests, including children. No exceptions will be made.
2. **No Smoking Policy:** Smoking within the condo is strictly prohibited.
3. **Pet Policy:** The presence of pets within the condo is forbidden. If a pet is discovered on the property without prior authorization, the guest will forfeit their deposit and may be required to vacate the premises prematurely without a refund. **Check-in Time:** 3 PM **Check-Out Time:** 11 AM (Please consult the binder provided in the condo for specific instructions.)

Swimming Pool Regulations:
1. Guests under the age of 15 must be accompanied by a parent or guardian while in the pool area.
2. Glass containers, pets, and tobacco products are not permitted in the pool area and security will fine any violators. There are pool cups provided in the condo for your use.
3. Running and horseplay within the pool or dressing rooms are strictly prohibited.
4. Fines will be imposed on guests who fail to comply with these regulations.
5. State-required regulations pertaining to the sauna, spa, and pool areas are posted in designated locations and must be respected.
6. The pools will close at 11 PM.

Courtesy and Consideration All residents are expected to utilize their units and common areas in a manner that respects the rights and privileges of fellow residents. Actions that may annoy, harass, embarrass, or otherwise inconvenience other property owners, residents, their guests, or the staff and representatives of the association are to be avoided. Residents must take reasonable precautions to minimize loud, disturbing, or objectionable noises or odors that may disrupt other residents.

An on-site security guard is responsible for enforcing curfews at both the pool and fitness facilities. This guard is authorized to impose fines and arrange for the towing of improperly parked vehicles. Additionally, surveillance cameras are strategically placed throughout the property to ensure the safety of all guests and property owners.

For additional comfort during the hot summer months, a portable air conditioning unit is available. **Please refrain from setting the Ecobee thermostat in the unit below 71°F during the summer months.** The resort utilizes a geothermal cooling system that relies on water sourced from Lake Travis; setting the temperature below 71°F may result in the unit freezing.

All garbage must be properly disposed of prior to check-out. A garbage chute is located directly outside the front door of the condo. Guests are required to ensure all garbage is securely bagged before disposal.

The extra ACs are especially amazing with how hot it's been this summer. The pools are refreshing. The spa is really good-get a couples massage if you can- we love those! The coffee bar set up is perfection and there are even extra spices and condiments. These owners have thought of everything to make life easier. Basically, throw your swimsuit in a bag with some shorts and go. We would love to keep this one as our personal secret, but it's too good not to share. VILLA RENTAL RULES

The following are rules each renter must abide by. Fines will be assessed for infractions of the rules.
This is not a resort - it is a residential community. The owners of these units value their privacy and quiet.

Occupancy: A Unit may be occupied by no more than two persons per bedroom, plus two, This means no more than 2 people per studio, 4 people per 1 bedroom unit, 6 people per 2 bedroom unit. The Island on Lake Travis reserves the right to prevent people entering the complex in numbers greater than stated here.

Pool behavior: Users under 15 must be accompanied by a parent or guardian. No glass ($1000 fine) no pets, no tobacco products, no running, no horseplay in the pool or dressing rooms. State required sauna, spa and pool rules are posted in the appropriate areas and must be followed. There is a limit of 4 guest visitors per villa. (Guest visitor is defined as persons other than Owner or renters named on the lease who are not staying overnight). All guest visitors must be accompanied by the Owner or renter. Pools close at 11 PM

Courtesy & Annoyance: Each Resident shall endeavor to use his Unit and the Common Elements in a manner calculated to respect the rights and privileges of other Residents. A Resident shall avoid doing or permitting anything to be done that will annoy, harass, embarrass, or inconvenience other Owners or Residents or their guests, or the Association's employees and agents.

Noise and Odors: Each Resident shall exercise reasonable care to avoid making or permitting to be made loud, disturbing, or objectionable noises or noxious odors that are likely to disturb residents of other Units.

Barbecue Grills: Charcoal and wood grills and similar outdoor cooking devices are not permitted on patios, terraces, desks or balconies. There are grills at both ends of the complex which may be used by residents.

Pets: Pets must be on a leash at all times. The pet’s owner is responsible for ensuring the pet uses the areas set aside for pet use for pooping and peeing, and for cleaning up that poop and pee. The owners of pets that bark loudly enough to disturb others in adjoining units will be told to remove the pet from the property. Fines will be assessed for infractions of these rules.

Garbage: Garbage is to be disposed of properly in the garbage chutes. The dumpsters are only for household waste- no furniture or construction materials are allowed.

Spa/Fitness Center behavior: Users of the fitness center must be 16 or older. Persons under 18 must be accompanied by a parent or guardian. The hours are daily, 8:30-4:30 pm M-Sat.

No food, no beverages, no glass, no pets, no tobacco products, no running (except on equipment designed for running), no horseplay in the fitness area. Use of the equipment is at the users own risk. The Association assumes no responsibility for injuries that may occur. There is a limit of 4 guest visitors per villa. (Guest visitor is defined as persons other than Owners or renters on lease who are not staying overnight). All guest visitors must be accompanied by the Owner or renter.

Parking: Renters may park in the slot(s) assigned to the unit being rented. DON’T ENCROACH/PARK OVER ANY YELLOW LINE BETWEEN SPOTS. All other vehicles associated with the renters must be parked outside at the north end overflow outdoor parking area. Guests who are not staying overnight may use one of the spaces designated for guests. Vehicles parked in guest spaces overnight, or in spaces belonging to another unit, are subject to being towed at the vehicle owner’s expense.

Smoking: Smoking is prohibited in common areas such as the pools, courtyards, spa and exercise area, picnic areas and marina. Smoking is permitted on individual unit decks.

The beautiful Lago Vista Sunset park is located 7.3 miles away. Sunset Park is the newest city park, it has a soccer field, baseball field, softball field, sand volleyball court and a walking trail.

If you just need a place to get together with your friends or family this is the place. This house has 3 stories. The 3rd Floor is the main floor, there you will find a full kitchen fully equipped for you. We have everything you need when you stay with us, refrigerator with ice maker, oven, stove, microwave, Keurig Duo with coffee pot and pods. We have a Margarita Ville. There are 3 bedrooms on the 3rd floor. The master has a king sized bed and the other two secondary rooms have queen sized beds. The master bedroom has its own private bathroom with a jetted tub and the guest bathroom is a full bathroom as well. On the 3rd floor you will find the main living area with fireplace and large TV. There is a large wrap around balcony on the 3rd floor with a propane grill, large seating area and dinning area that seats 8. On the second floor you will find 2 bedrooms. One bedroom has a twin over full bunk bed with another twin sized bed by its side. In the other bedroom you will find a queen sized bed and a TV. The second floor also has our game room. The game room has ping pong, pool table, arcade, large TV with seating area and our Theater Room with big screen projector and pop corn machine. We have a pellet grill located outside on the large second floor balcony. On the balcony you will find another dining area with extra seating for lounging and corn hole. On main floor you'll find our hot tub ready for you. There is fire pit located outside on the ground level near the hot tub. Overall this home will have everything you want for your next get away, family vacation, reunion baby shower, whatever your needs may be.

All of our needs were met, including a requested early check-in,so we did not need to reach out again. The only suggestion I would make, there are absolutely no mirrors in this home except for the bathrooms. And the linen was scarce. Just enough bath towels for each one of us to have one. I’m sure if you contacted her she would supply more though. Otherwise it was a nice stay and a very nice home and very clean, which we really appreciated! Basically a five star review. The downstairs unit will be occupied by the owner with a completely separate entrance, separate kitchen and bedrooms, and the owners’ unit is also locked for privacy. The connecting staircase is locked down with a security door, thus, there is no physical access between the upper and lower floor units. Guests and hosts will not have any common areas to share and won't see each other due to the physical separation across two different floor levels. However, sounds may travel through the walls and the staircase.

There are two community pools available for the guests:
1) Lago Vista Community Pool inside Bar-K Park. Free of charge with a guest pass. Our pool season begins in mid-May and runs through September 30, depending on weather.
2) Lago Vista City Pool. Bring cash, there is a small entry fee ($3.50).

The Space:
Inside our home, you’ll find an open-concept layout where the living room, kitchen and dining area flow seamlessly together. Plush leather seating is joined by a fireplace, vaulted ceiling with wood beams, and walls of windows with tree views. Over in the kitchen, saddle up to the island for breakfast before your lake day.

Our three bedrooms and a sofa bed in the living room can sleep up to 10 guests. Rest easy among comfy beds and soothing blue and white color palettes. Picture windows let in natural light, while all rooms also have smart TVs and fans.

This gated resort offers condos for rent whether it be long or short term. A very unique aspect about our property is each condo is done to individual owners taste.

The Island on Lake Travis is the perfect spot to enjoy a relaxing romantic escape, and enjoy wildlife and breathtaking sunset views over the lake. There are plenty of local attractions to explore to keep you busy if you are looking for something fun and exciting to do. Take a day trip to Marble Falls or Fredericksburg, check out one of the 18 hole golf courses nearby, or enjoy a wine tasting at a Flat Creek Winery! When you rent from North Shore Vacation Rentals, you can expect top-notch customer service, and dedication to make your stay as enjoyable as possible. Each of our condos come with a fully equipped kitchen and linens for the bedrooms and baths. Covered Parking is on ground level with reserved parking, and additional “guest” spaces as well. There are 5 elevators on property.

We provide our guests with check in information prior to their arrival, which will include the front gate code, assigned parking spaces, directions to the condo and door code for added convenience. (Front Desk Check In is not required, and allows guests to arrive and access condo late at night if necessary).

- "It would be fine for short stays, like a weekend or a week and who don't do a lot of cooking. For longer stays like we did of 2 months, it needs more. We had to resort to using the guest shower as the ensuite water pressure was way too low. Couldn't get the shampoo out. The shower head was awful. The water pressure from the sinks was also too low. There wasn't enough cooking equipment like cookie sheets or muffin tins. We had to clean all the dishes and pots by hand as they had only been put through the dish washer and that doesn't clean things. We don't use a dish washer. We scrubbed the bottom of the frying pans because they were black. Then everything stuck to them and we threw out a bunch of food. We went and bought new non-stick pans which we gave to our granddaughter when we left. The stove wasn't good for a lot of cooking. Being vegans we have to eat in mostly. The toaster was terrible and there were only 4 soup spoons. No potato masher, measuring spoon, measuring cups and things like that. Thankfully, I brought a lot of my own stuff. Other than that, visiting with our granddaughters, boyfriends and great granddaughter and her grandparents was great. They all come for Grandma's cooking."
