The condo is located on the first floor and you are about 20 feet from the slopes with a great balcony view. Both bedrooms have private access to the bathrooms. There is a bunk room for the kids or young at heart. The kitchen is equipped with all amenities that you would need to cook a full meal. The living room has a futon, large sectional, 52 inch Smart TV, and a heat-emitting electric fireplace.

VACATION RENTAL AGREEMENT
This Vacation Rental Agreement (the Agreement) is made by and between ASHWOOD RENTALS..(HOMEOWNER) and ............................................................. (Guest) as of the date last set forth on the signature page of this Agreement.

For good and valuable consideration, the sufficiency of which is acknowledged, the
parties hereby agree as follows:
1. Property: The vacation rental property is located at: 601 Winterplace Dr. Unit D106 Ghent, WV 25843
The property is fully furnished and includes: fully furnished kitchen and linens for beds. TOWELS ARE NOW PROVIDED

2. Maximum Occupancy: The maximum number of guests is limited to 10 persons (including children). Two futons are available in the living room for sleeping space.

3.Term of the rental: The vacation rental begins at 5:00 p.m. on (“Check-in Date”)
and ends at 11:00 a.m. on (the “Check-out Date”). Early check ins may be available. Contact owner if needed. Failure to adhere to the check-out time may result in an additional late fee set at $50/hour unless discussed in advance of the stay.

4. Minimum Stay: This property requires a 2 night minimum stay. Holiday weekends require a 3 night minimum stay. Longer minimum stays may be required during other periods.

5. Rental Rules: Guest agrees to abide by the Rental Rules at all times while at the
property, and shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while residing at the property. Be respectful of the property and of neighboring guests. Repeated and/or severe complaints from neighboring guests may result in removal from property without refund.

6. Access: Guest shall allow Homeowner access to the property for purposes of repair, inspection or emergency. Homeowner shall exercise this right of access in a reasonable manner by giving at least 2 hours notice (unless in case of emergency).

7. Responsible Party: The person reserving and paying for the condo will be the responsible party and must be 25 years of age or older.

8. Housekeeping: Your paid reservation includes a charge for cleaning the condo. If, due to unforeseen circumstances (for example, severe weather, housekeeping shortage, etc.), we are unable to clean your condo prior to your stay, you will be refunded the cleaning fee. No other refunds will be given. Before checking-out, please bag and dispose of all trash in the dumpsters located outside, wash and put away the pots and pans, and start the dishwasher. We do not provide daily housekeeping service.

9.Pets: Please contact owner about any possible pets for approval. Pet deposit required.

10.Smoking: No smoking is permitted inside the dwelling. Failure to abide by this regulation will result in an automatic forfeiture of damage deposit. Smoking is only allowed in parking lots and dispose of smoking materials properly.

11. Property Missing/Damage: Please report any broken, damaged, missing or inoperable items as soon as you notice it. Even if the issue does not affect your stay, we appreciate you letting us know before you check-out so that we can make arrangements to resolve the issue prior to the next guest arrival. Please do not bring cookware or other items from one condo to another. If you have a larger group and book multiple condos, we suggest that you bring paper plates/cups to avoid moving dishes from one condo to another. Any property in the rental that is removed/broken/abused may be deducted from the security deposit

12. Water Leaks: If you encounter a major water leak, please shut-off the main water supply (found in the hall closet above the hot water heater) and call immediately. For small drips, please place a towel or bowl under the drip and notify us during normal hours. Please make sure you notify us if you suspect a leak (wet carpet, water under sink, etc) so that we can take care of it right away and minimize any damage to our condo or to a neighbor’s condo.

13. Your Belongings: Please gather all personal belongings before checking out. If we find you have left valuable items behind, we will contact you and arrange to return the items. The minimum charge to return forgotten items is $20.00 plus shipping fees.

14. Cancellation: If you cancel your reservation at least 60 days prior to your scheduled arrival date, you will receive a full refund except for a $100.00 cancellation fee (per condo) and any paid credit card fees. If you cancel your reservation less than 60 days from your arrival date, then no refunds or credit toward a different stay will be issued (except for cleaning fee, which will be refunded).

15. Refunds: There are no refunds (or credit toward a different stay) for Winterplace closures, poor snow conditions, severe weather, late arrivals, early departures, travel conditions, road closures, allergies, health or medical issues, utility or water outages, mandatory evacuation, construction at neighboring properties, war, terrorism or acts of God. We will make every
reasonable effort to ensure that the appliances, fireplaces, and like amenities are and remain in good working order. However, there is no refund if these are inoperable.

16. Trip Insurance: We understand that circumstances may arise that affect your reservation. We recommend that you purchase Trip Insurance. We do not offer trip insurance, but there are many options available if you search the internet. You should consider Cancel for Any Reason (CFAR) coverage since a typical policy without that extra coverage will not cover you in the event you want to cancel to due lack of snow, poor conditions, etc.

17. Cancellation by Owner: In the event the particular condo you have reserved is not available due to unforeseen circumstances, we will make every effort to relocate you into another one of our condos but assume no further liability. If there are no other condos available, then a complete refund will be given and we assume no further liability.

18. Condo Changes: The Owner reserves the right to change your reservation to another same-floor condo at the Owner’s discretion. Although rare, the Owner may need to assign you a different same-floor condo than the one you originally reserved due to scheduling constraints.

19. Falsified Reservations: Any reservation made under false pretenses will be subject to forfeiture of booking deposit and rental payments, and check-in will not be allowed.

20. Binding Agreement, Agency, Warrants and Venue: Your rental agreement is a binding contract between you and the property Owner. The rental contract shall be interpreted and governed by West Virginia law. Any legal action pertaining to your rental must be brought exclusively in the appropriate court within Raleigh County, State of West Virginia.

21. Defend, Indemnify and Hold Harmless: As a condition of this rental agreement, to the fullest extent permitted by law, you as Guest, on behalf of yourself, members of your party and all their successors, assigns and heirs, agree to defend, indemnify, and hold harmless the Owner and any of their employees, or representatives thereof, of and from any and all costs, suits, liabilities, damages and/or claims for damages arising from the acts or omissions of any person or which is in any other manner whatsoever related to the rental property and the related property, including but not limited to those arising from any kind of injury to or the death of any person or persons in, on or about the rental property and related property, or from any loss of or damage to the rental property or the personal property of any person or persons in, on or
about the rental property and related property, except that this indemnification does not extend to claims for personal injury actually caused solely by the grossly negligent acts or willful misconduct of the Owner or its employees.

The condo is located on the FIRST FLOOR of the Winterhaven complex and is the closest to the parking lot and is the easiest condo to get in and out of with all of your gear. The building does not have an elevator so if you rent on the second or third floor then be prepared to carry all of your luggage up and down some cold and snowy walkways when you arrive. The last thing you want to have to do on vacation is carry all of your heavy stuff up multiple flights of stairs after driving so stay in my condo on the first floor and avoid all of that nonsense!

Get your exercise on the slopes and not on the stairs!!!

As you walk into the front door you enter the bunk room where there is a bunk bed and storage for ski boots and skis. There are mats on the floors for the ski boots and ski holders on the walls for the skis! Very convenient!!!

Through the bunk room takes you into the rest of the condo where down the hallway on the right is one of the bedrooms that has a queen bed as well as a washer/dryer and flat screen TV. In addition there is a full bath with shower and tub.

To the left and down the hallway takes you into the open kitchen and living room area. The kitchen has a full size stove, oven, refrigerator, dishwasher, and microwave. Your morning will start off perfectly as you wake up and start to make coffee in the full size coffee maker which sits beside the kitchen sink and at the same time you can look out the kitchen window and see the ski slopes and ski lifts!

In the living room there is a futon that converts into a bed as well as a huge sectional couch that all face into the electric fireplace.

Walk through the living room and on the right is a sliding glass door that takes you to the deck which overlooks the slopes and the picturesque WV mountains. On the left is the other bedroom with queen bed and private bathroom and shower. There`s also a flat screen TV in this bedroom with cable just in case you want to catch some TV.

This house is also a short distance from the New River Gorge National Park - whitewater rafting, climbing, biking. 15- 20 minutes from the Grandview area of the Park and 30-40 minutes from the NRG bridge/Fayetteville area.

This property is located right alongside one of the beginner ski runs close to a chairlift. Winterplace offers 27 trails, nine lifts (two quads) a snow tubing park and night skiing until 10:00 PM.

Winterhaven Condos are located on the right side of Winterplace Ski Resort, at the top of Highland Run, Last Run and at the bottom of Last Chance ski run. The condominiums are minutes off of I-77 for easy access. The condo is located on the third floor of the complex and has amazing views off its private deck! THERE IS NO POOL AT THIS CONDO COMPLEX even though VRBO says that there is one.

Highland Run is down the steps - put on your ski's and go! Walk to other side of the condos for access to the "Last Chance" run! The views from the balcony, which are accessible from the Master bedroom and the living room, are beautiful! The bedrooms are on opposite ends of the unit with the bunk bed room/mud room being in the middle. The master bedroom has a private bath and the other bath is near the bunk bed room and other room. The kitchen is equipped with all amenities that you would need to cook a full meal. The living room has a large sectional, queen size futon, Smart TV, and a fireplace.

The road to the condos is gravel and up a hill which is maintained by Winterplace Ski Resort. Sometimes heavy rains cause ruts in the road. If you are not driving a truck, low clearance vehicles will need to be very careful coming up the hill to the condos from Winterplace Ski Resort's main parking area. In the winter, you may need a four wheel drive or all wheel drive to get up the hill.

About 30 to 35 minutes away are Beckley, for shopping/dining/movie theaters AND New River for Whitewater rafting! About 15 minutes away is Glade Springs Golf Resort for golfing and spa treatments! About 5 minutes down the hill, SKyline Lodge has a pub and grill, outside area overlooking the water & music (check their website for dates/times).

Please purchase travel insurance to protect your vacation investment in case you have last minute problems. VRBO offers travel insurance, or contact your insurance agent they may have a recommendation.

This 3 level chalet offers over 3,000 square feet of well maintained, ski in ski out, lodging at Winterplace ski resort. It is also an easy 40 minute (highway) drive to the New River Gorge National Park (hiking, biking, climbing, rafting, ziplining, etc)

There are 6 bedrooms, 2 full kitchens, 3 full baths, 2 washer/dryer sets and upper and lower deck area.

This is a great set up for large groups or multi family groups looking for open comfortable space with great access to the slopes and beautiful views. This house is also an easy 40 minute drive from the New River Gorge recreational area - whitewater rafting, climbing, biking.

This property is located right alongside one of the beginner ski runs close to a chairlift. Winterplace offers 27 trails, nine lifts (two quads) a snow tubing park and night skiing until 10:00 PM.

Winter Place Ski resort is Conveniently located off Interstates 64 & 77 at Flat Top (Ghent) West Virginia elevation 3252.

The kitchen is totally equipped with all the essentials, including crock pot, coffee maker, pots and pans, a built-in microwave, dishwasher and everything that you need for your vacation.

The living room consist of an electric fireplace and a view out the sliding glass doors onto the slopes. The master bedroom has a queen bed with a bath and views onto the mountains.

Everything you need to create great family memories!

The condo has electric baseboard heaters in each room, so you can adjust the heat to the temperature that you prefer when it's cold outside. When it's hot, there is an AC unit installed in the living room above the sliding glass door. This is for AC only. We are not allowed to do duct work in the 2nd or 3rd floor condos, so this is the only practical way to get AC in the unit, leaving room doors open as often as possible helps to keep the whole condo cool.

Please be aware when you book on our website or VRBO there is a fully refundable $200 security deposit that is added when you are booking your reservation on our website. This is required and will be refunded to you with-in 15 days of your check out as long as no damage done to the property. This is a standard practice for vacation home rentals as there is no staff at the facility and this allows you to check in with an electronic door code and check out by just leaving the morning of your last day.

Also, the road to the condos is a gravel, hilly, road that is maintained by Winterplace Ski Resort. Low clearance vehicles will need to be careful coming up the hill from Winterplace Ski Resort's main parking area. In the winter, they grade the road and keep it plowed and put cinders on the road but please be prepared and understand you may need a four wheel drive, all wheel drive or chains to help get up the hill.

We highly recommend that you purchase travel insurance. Problems can arise in multiple ways and travel insurance can be a low cost guard against losing your money if you have last minute problems and have to cancel. In the past, some of our guests have obtained insurance by going to www.InsureMyTrip.com for details and to purchase. We did call the people at InsuraneMyTrip and they do have plans that will cover for Covid issues but there are several important steps and needs to be done shortly after making your first deposit. The plans are called "Cancel For Any Reason" CFAR. Check with your insurance agent before deciding what insurance to purchase. We DO NOT endorse any insurance in particular.

NEAR BECKLEY AND WHITEWATER COUNTRY

During the spring, summer and fall don’t think there is nothing to do. We are close to all the fun that southern West Virginia has to offer. Whitewater rafting, kayaking, river tubing, rock climbing, hiking, horseback riding etc. All different kinds of outdoor fun are waiting for you to take advantage of.There are several state and national parks near by, like Little Beaver State Park and Grandview National Park. We are also near Summit Bechtel Family National Scout Reserve. The temperature in the mountains of West Virginia remains cooler than a lot of the surrounding states, so this is great place to come cool off. Enjoy something different from the beach, take your family out into nature.

And for anytime of the year fun, Beckley has something for everyone. Of course, there are all your favorite fast food and sit down restaurants, as well as some home-grown restaurants that might become your new favorites. There is a wide variety of different shops. The Tamarack has everything you might want to see from our unique West Virginia craftsman. There are a lot of different antique shops and Crossroads Mall for those that might want something a little familiar. There is the Beckley Exhibition Coal Mine, where you can tour an actual coal mine and let the kids explore the coal mining town and the Youth Museum. During good weather, there are also trails, playground, basketball and tennis courts and a pool with a waterslide. There is also, Mountain State Miniature Golf which doesn’t have just mini-golf but offers a small coffee shop and an indoor climbing wall. Beckley is a great place to spend a few days exploring all it has to offer and it’s only a quick drive up Interstate 77.
